Agreement to Terms

Welcome to Klen AI, Inc. ("we," "us," "our," or "Klen AI"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Klen AI, Inc., a company incorporated in Delaware, United States, regarding your use of our AI-powered recruiting platform and related services.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

Applicants: If you submit a job application through a public careers page hosted by Klen AI, these Terms also apply to you. You are applying to a job posted by a third-party hiring organization (the “Recruiter”). Klen AI is not the employer, does not make hiring decisions, and is not responsible for the Recruiter’s employment practices.

Important: Please read these Terms carefully and keep a copy for your records. These Terms include important information about your rights and responsibilities, as well as limitations and exclusions that may apply to you.

Public Job Applications

We may host public job listings and application forms on behalf of Recruiters. When you apply, you submit information to the Recruiter and to Klen AI so we can operate the application workflow.

Information You Provide

  • Contact details and application information (e.g., name, email, phone, location)
  • Application materials (e.g., resume/CV, cover letter, and question responses)
  • Consent choices you make in the application form

How Applications Are Processed

  • We transmit your application to the Recruiter and make it available in the Recruiter’s account
  • We may automatically parse and analyze your resume to help the Recruiter review applications (human decisions remain required)
  • We may collect limited technical data (e.g., IP address, user agent, referrer URL, and UTM parameters) to secure the service and prevent abuse

No Employment Relationship

Klen AI is a technology provider. The Recruiter is responsible for the job listing, the hiring process, and any employment decisions. We do not guarantee that a Recruiter will review your application or contact you.

User Accounts and Responsibilities

Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to create an account
  • One person or entity may not maintain multiple accounts

Acceptable Use

  • Use our services only for lawful recruiting and hiring purposes
  • Comply with all applicable employment laws and regulations
  • Respect candidate privacy and data protection rights
  • Do not use our services to discriminate against protected classes
  • Do not attempt to reverse engineer or compromise our AI systems

Prohibited Activities

  • Harassment, abuse, or discrimination of any kind
  • Sharing false or misleading information about candidates or positions
  • Attempting to gain unauthorized access to our systems
  • Using our services for any illegal or fraudulent purposes
  • Interfering with the proper functioning of our platform

Privacy, Data, and Communications

Our collection and use of personal information is described in our Privacy Policy, and our use of cookies and similar technologies is described in our Cookie Policy.

Recruiters (Business Users)

  • You are responsible for the content you collect and upload, including candidate and employee data
  • You represent that you have a lawful basis and all necessary rights/permissions to process and share personal data with us
  • You agree to comply with all applicable employment, privacy, and anti-discrimination laws

Applicants

  • Your application is submitted to the Recruiter; we process it to provide the application workflow and related services
  • We may use automated tools (including AI) to extract information from resumes and help organize applications for review
  • We may send service-related emails (e.g., application confirmations and status notifications)

Data Retention

We retain information for as long as reasonably necessary for the purposes described in our Privacy Policy, including to provide the Services, maintain security, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods may vary by customer plan, configuration, and applicable law. Some information may persist in backups, logs, or derived/aggregated datasets.

AI Services and Limitations

AI-Powered Features

Our platform uses artificial intelligence to enhance recruiting processes. These AI features include:

  • Candidate matching and ranking algorithms
  • Resume parsing and skills extraction
  • Interview transcript analysis
  • Voice assistant interactions
  • Automated communications and scheduling

AI Limitations and Disclaimers

  • • AI recommendations are suggestions only and should not be the sole basis for hiring decisions
  • • AI systems may have biases and limitations that could affect results
  • • Users remain responsible for compliance with employment laws and regulations
  • • AI-generated content should be reviewed and validated before use
  • • Voice assistant interactions are recorded and may be used to improve services

Human Oversight Required

While our AI systems are designed to assist in recruiting processes, human oversight and final decision-making remain essential. Users are responsible for:

  • Reviewing AI recommendations before making hiring decisions
  • Ensuring compliance with anti-discrimination laws
  • Validating AI-generated content for accuracy
  • Maintaining appropriate human involvement in the hiring process

Google Workspace Integration

User Responsibilities

  • Maintain valid Google Workspace account credentials
  • Grant appropriate permissions for our platform to access Google services
  • Comply with Google's usage policies and rate limits
  • Monitor and manage your Google API usage quotas
  • Revoke access if you no longer wish to use the integration

Intellectual Property

Klen AI retains all rights, title, and interest in:

  • The Klen AI platform, software, and technology
  • AI models, algorithms, and proprietary methodologies
  • Trademarks, logos, and brand elements
  • Documentation, content, and user interfaces
  • Improvements and enhancements to our services

Your Rights

You retain ownership of:

  • Your company data and candidate information
  • Job postings and recruiting content you create
  • Your business processes and methodologies

License Grant

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, copy, transmit, and display your data and content as needed to provide, maintain, secure, and improve the Services. We may also create and retain aggregated or de-identified data derived from use of the Services. Our use of certain third-party data sources (such as Google Workspace APIs) is limited as described in our Privacy Policy.

Payment and Subscription Terms

Subscription Plans

Payment Terms

  • Scheduled maintenance may cause temporary service interruptions

Customer Support

  • Email support available for all users
  • Response times vary by subscription plan
  • Priority support for premium and enterprise customers
  • Documentation and self-help resources available

Data Backup and Recovery

  • Regular automated backups of platform data
  • Disaster recovery procedures in place
  • Users responsible for backing up their own data
  • Data export tools available for premium users

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Klen AI, Inc. and our affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your access to or use of the Services
  • Your content, job postings, or application materials you submit
  • Your violation of these Terms or applicable law
  • Your hiring decisions, screening practices, and compliance obligations (for Recruiters)

We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

Limitation of Liability

Please read this section carefully as it limits our liability to you.

Disclaimer of Warranties: Our services are provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Limitation of Damages: To the maximum extent permitted by law, our total liability for any claims arising from or related to our services shall not exceed the amount you paid us in the twelve months preceding the claim.

Excluded Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

AI-Specific Limitations: We are not responsible for decisions made based on AI recommendations, bias in AI systems, or hiring outcomes resulting from use of our platform.

Termination

Termination by You

  • You may terminate your account at any time
  • Cancellation takes effect at the end of your current billing period
  • You remain responsible for all charges incurred before termination

Termination by Us

We may terminate your account if you:

  • Violate these Terms of Service
  • Engage in prohibited activities
  • Fail to pay required fees
  • Misuse our AI services or platform

Effect of Termination

  • Access to our services will cease immediately
  • Data will be retained according to our Privacy Policy
  • Certain provisions of these Terms will survive termination
  • You may request data export before termination

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution

We prefer to resolve disputes amicably. If formal resolution is required:

  • Disputes will be resolved through binding arbitration
  • Arbitration will be conducted in Dover, Delaware
  • Each party will bear their own legal costs
  • Class action lawsuits are waived

Exceptions

Either party may seek injunctive relief in court for intellectual property violations or breaches of confidentiality.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by:

  • Posting updated Terms on our website
  • Sending email notification to your registered email address
  • Providing in-app notifications for significant changes
  • Updating the "Last updated" date at the top of these Terms

Continued use of our services after changes become effective constitutes acceptance of the updated Terms.
